Our website address is: https://ffcagent.shop and is owned & maintained by Pixel Factory CC (T/A Design Desk). When you sign up on this site, you enter into a contract with Pixel factory CC. Company registration No: 2007/085469/23
Hereafter, the term “we”, “us” or “our” refers to Pixel Factory CC
The terms “you”, “your” or “the customer” refers to the paying customer/member. (ie: you, the person who is reading this document)
Pixel Factory CC is not a subsidiary of Fine Fragrance Collection (Pty) Ltd.
Term of the contract
Membership is monthly and active from the date of signup with a completed initial payment.
Membership is required for your e-commerce website to be live and functioning. (no membership, no website.)
We are responsible for your e-Commerce website and its hosting, but not the product you sell, your service levels or your Agent relationship with Fine Fragrance Collection.
We assume you are legally capable of entering into binding contracts and you are at least 18 years old.
Payment
Payment of your monthly membership fees will be made via an automated recurring processed through PayFast payment gateway, managed through the website ffcagent.shop.
No manual payments will be accepted. eg: cash or EFT.
Membership fee changes
Pixel Factory CC reserves the right to change pricing of membership levels and/or create new membership levels without consultation.
Notice of upcoming price changes will be sent out to all members by email, at least one (1) monthly billing cycle to give all members sufficient notice time to cancel.
Fee increases will be about 5-10%. Unexpected changes to current inflation, hosting pricing and international exchange rates are out of our control and may force a greater increase to be necessary.
Cancellation of your membership
Login to your account on ffcagent.shop where your membership is held and cancel your membership from the “My Account” page. This will cancel your recurring payment – no more fees will be deducted from your bank card.
Your membership will automatically end on the day of your next scheduled payment.
All services will continue to function up to your last day of your membership.
There are no cancellation fees or notice period.
Failure to pay
Failure to make payment (eg: your cheque card expires and cannot be processed for payment) will result in your membership being suspended.
Your e-Commerce website will be suspended within 24 hours of your failure to pay. However, the site and all its data will not be immediately deleted. This is to allow you time to resume payment and restore your website without any data loss.
Seven days after membership cancellation, your site will be deleted. Upon deletion, your data will not be able to be restored.
Restoring your account after membership cancellation
Upon membership cancellation (whether intentionally through the website or accidentally through non-payment), your website will be suspended.
Seven (7) days after cancellation, your website and all its data will be deleted.
During this seven day window, you may contact Stephen Hampton and arrange new payment terms to restore your membership account and your website. No data will have been lost so you can continue trading with all clients and order history in tact.
Refunds
Under South African Consumer Rights laws, you have the right to a full refund of your first payment. This is known as a “cooling off period” and lasts seven days.
A refund must be requested before the commencement of building your e-Commerce site.
We only start building your site after you have furnished us with all relevant information to use on the site, so if you have not yet provided us with this relevant information, you may request a refund. (eg: payment gateway account details, information to display on the site – as outlined in the downloadable Excel spreadsheet.)
Submitting required information is confirmation that you wish to proceed with your membership and you forgo your right to a refund.
Pixel Factory CC will only issue a refund within 7 days of initial payment, prior to commencement of building the website takes place.
Refunds on subsequent, monthly subscriptions fees will not be issued.
If you have cancelled your membership, and a payment still comes off your bank account in error, please send us proof of cancellation and we will refund this payment.
We reserve the right to make all refunds within a 30 day period. Refunds will be made electronically by EFT only. No cash.
Rights to your e-commerce website
Your e-Commerce website remains the property of Pixel Factory CC.
You may promote your site, transact through it and manage all clients, orders, products blogs, gallery and media (pictures) you uploaded.
You may request Pixel Factory CC to make changes to it, but your ability to make changes is limited or prevented.
You may only sell products that are available through your agent status through Fine Fragrance Collection. No other products, perfumes or associated products or services, from other suppliers or yourself may be sold through your e-Commerce website.
You may not copy, download or transfer your e-Commerce site to another domain or another hosting account.
Pixel Factory CC does not have any rights to your clients, their details or order history.
Training
Pixel Factory cannot run your e-Commerce website for you, but we do provide training and 1-on-1 assistance to ensure you know how to manage your customers and process orders.
Training may be done 1-on-1 in person, via video conference or in groups through webinars. This will be decided upon at Pixel Factory CC’s discretion and is based upon current capacity.
Training will be provided within 7 days of the completion of the setup of your e-Commerce site.
Email accounts
On the higher level package, a single email account is included for free and is limited to 1 GB in storage size.
This email account can be accessed through a webmail in your browser and it can be installed in an email application like Outlook, Apple Mail, Thunderbird and will work on Windows, Apple and Linux operating systems.
We do not provide IT support and are not responsible for IT-related issues on your computer, tablet or cellphone. We will assist in setting up email on your computer, but once it is working, then it is your responsibility to manage it.
We cannot restore deleted emails.
This email account will be created to match the domain name of your site. eg: if your site is called stephen.ffcagent.shop, then your email will be stephen@ffcagent.shop
You are under no obligation to use this email account. You may use an email account of your choosing on the site and for email notifications – like on the lower lever package.
Because we host this email account, we are able to read all emails in this email account. We do not access your emails without your permission. The following are possible scenarios that we may access your email account:
- Initial setup and testing your email account
- Training you on how to use your email
- Troubleshooting an email issue you may be experiencing.
- Assisting you to understand/process an order
- Troubleshooting an order (eg: a claim that the notification email was never sent out or received)
Payment gateway
The standard e-Commerce website outlined in our packages are subject to using Netcash as the payment gateway.
You will need to sign up for an account with Netcash and satisfy their needs for FICA documentation.
Pixel Factory CC will assist agents with the sign up process with Netcash and provide a personal assistant working at Netcash to guide you through the signup and assist in all issues regarding payouts and how to use the Netcash platform.
Other payment gateways can implemented upon request, but this will carry an installation fee of R350.00 ZAR. Pixel factory CC cannot guarantee your preferred payment gateway’s compatibility with the website, nor assist in any guidance with them. (We cannot know the inner workings of every payment gateway active in South Africa)
The payment gateway used by Pixel Factory CC to process your membership fees is PayFast. Your banking data is stored with them, not us. We never see your banking information (eg: any credit card details) nor have access to it. PayFast does not make this data available to us, even upon request. (The same applies to Netcash and your clients’ banking details – this is how payment gateways operate)
Courier integration
The entry level package does not include the integration of a courier.
The higher level package does include the integration of one courier of your choice. Additional couriers will carry and integration fee of R650.00 ZAR.
You will need to sign up with an account directly with a courier. While couriers seldom require FICA documentation, you will be paying them directly for deliveries – some are pre-paid and and others are post-paid on account so their requirements will vary, but these accounts will have to be in your name.
Exemptions
Pixel Factory is not responsible for any of the following:
- Any potential lost sales due to site functionality, visibility, non-payment, server visibility, internet outages, DNS propagation or any other technical event that might prevent a sale from being made on your e-Commerce site.
- Failure by you to notice an order because you missed the email notification of a new order. (there are many reasons why an email might not reach you, eg: firewalls, spam filters, message rules, internet availability, unknown technical glitches etc. none of which we can be aware of)
- Any failed, incorrect or rejected payments through your payment gateway.
- Incorrect customer details, including incorrect delivery addresses, that may result in your failure to deliver on any orders.
- Non delivery by your courier company.
- Any quality regarding the perfumes you sell or deliver. Any wrong orders received or production quality issues must be taken up directly with Fine Fragrance Collection’s customer Service.
Communication
As a customer, we reserve the right to communicate with you.
We will communicate directly with you via email, using the email address you provided us at sign up.
We will not send you spam.
